FCC AQUALIA (hereinafter, the Entity), belonging to the FCC Group (www.fcc.es), is the owner of this web portal (hereinafter, the Portal). Its registered office is located at Av. Camino de Santiago 40, 28050 Madrid, and its Tax Identification Number (CIF) is A-26019992. Electronic contact with the Entity can be made through the contact page.

The Entity is registered in the Commercial Registry of Madrid, dated July 23, 2002, Volume 17248, Folio 130, Section 8, Sheet M-58878, inscription 369. The domain name through which you have accessed the Portal is owned by the Entity.

2. Purpose

This Legal Information page sets out the conditions of use that regulate the access, navigation, and use of the Portal, as well as the responsibilities derived from the use, provision of services that, where applicable, may be offered, and the contents that comprise it. This is without prejudice to each Entity's ability to establish particular conditions that regulate the use and provision of services that may be offered to Users through the Portal. In any case, such particular conditions shall form an integral part of this Legal Notice.

The mere access to the Portal, the completion of forms, the sending of requests for information, queries, complaints, and, in general, any act of a similar nature to the above carried out through the forms and/or electronic mailboxes on the Portal shall imply, provided that you have given your consent for the sending of the above, your unreserved acceptance of each and every one of the rules comprising this Legal Notice and the acquisition of the status of User of the Portal. Consequently, you must carefully read and understand the content of this Legal Notice.

If the use or provision of services is offered through the Portal, the fact that they are used and/or requested by the User will also imply the unreserved acceptance of the particular conditions that may have been established for that purpose, which will form an integral part of this Legal Notice.

3. Access and Use of the Portal

Access to the Portal by Users is free of charge. However, the use or provision of services that may be offered by each Entity may be subject to prior compliance with formal requirements, such as the completion of the corresponding form, payment of expenses or fees, and/or the prior acceptance of the particular conditions applicable to them.

The mere access to the Portal does not imply, in itself, the establishment of any kind of commercial link or relationship between each Entity and the User, except when the appropriate means for this have been established and the User has previously complied with the requirements that may have been set.

The inclusion on the Portal of information relating to products or services offered by the Entities is exclusively for informational and advertising purposes unless another purpose is expressly established.

If, for the use or provision of a service offered through the Portal, the User must register, they will be responsible for providing truthful and lawful information, guaranteeing the authenticity of all the data they enter when filling out the pre-established forms to access the products or services in question. If, as a result of registration, the User is provided with a password, they undertake to use it diligently and keep it secret. Consequently, Users are responsible for the proper custody and confidentiality of any identifiers and/or passwords provided to them by each Entity, and they undertake not to transfer their use to third parties, whether temporarily or permanently, nor to allow access to them by unauthorized persons. The User shall be exclusively responsible for the use of the services by any illegitimate third party who uses a password for this purpose due to a non-diligent action or the loss of the same by the User.

By virtue of the foregoing, the User is obliged to immediately notify each Entity of any fact that allows the improper use of identifiers and/or passwords, such as theft, loss, or unauthorized access to them, to proceed with their immediate cancellation. As long as such facts are not communicated, each Entity shall be exempt from any liability that may arise from the improper use of identifiers or passwords by unauthorized third parties.

In any case, the access, navigation, and use of the Portal and, where applicable, the use of the services or products offered through it, is done under the sole and exclusive responsibility of the User, who thereby undertakes to diligently and faithfully observe any additional instruction given by each Entity or by authorized personnel of each Entity regarding the use of the Portal and its contents.

Therefore, the User is obliged to use the contents, products, and services diligently, correctly, and lawfully, following current legislation, and, in particular, undertakes to abstain from:

(i) Using them for purposes or effects contrary to the law, morals, generally accepted good customs, or public order, and the instructions received from each Entity.

(ii) Using them for purposes that harm the legitimate rights of third parties.

(iii) Using the contents and products and, in particular, information of any kind obtained through the Portal or the services to send advertising, communications for direct sales purposes or any other commercial purpose, unsolicited messages addressed to a plurality of people regardless of their purpose, as well as abstaining from commercializing or disclosing such information in any way.

4. Responsibilities and Limitations

The Entities cannot guarantee the reliability, usefulness, or veracity of the information provided through the Portal.

Consequently, the Entities do not guarantee nor hold themselves responsible for:

(i) The continuity of the contents of the Portal and/or the lack of availability or accessibility of the Portal or its technical continuity;

(ii) The absence of errors in such contents or products;

(iii) The absence of viruses and other harmful components in the Portal or on the server that supplies it;

(iv) The invulnerability of the Portal and/or the impregnability of the security measures adopted therein;

(v) Where applicable, the lack of usefulness or performance of the contents or services of the Portal;

(vi) The damages or harm caused, to themselves or a third party, by any person infringing the conditions, rules, and instructions that the Entities establish on the Portal or through the breach of its security systems;

(vii) Any other damages that may be caused by reasons inherent to the non-functioning or defective functioning of the Portal or the websites to which links may have been established.

Nevertheless, each Entity declares that it has adopted all necessary measures, within its possibilities and the state of technology, to guarantee the functioning of the Portal and to avoid the existence and transmission of viruses and other harmful components to Users.

The specified Entities make their best efforts to avoid errors in the contents published on the Portal. All contents offered through the Portal are updated, and each Entity reserves the right to modify them at any time. The Entities are not responsible for the consequences that may arise from errors in the contents provided by third parties that may appear on the Portal.

Any communication or transmission of content that infringes the rights of third parties and whose content is threatening, obscene, defamatory, pornographic, xenophobic, offensive to human dignity or children's rights, current legality, or any conduct that incites or constitutes a criminal offense is prohibited.

Likewise, the inclusion and communication of contents by users that are false or inaccurate and that induce or may induce error in other users or the staff of the Entities is prohibited, particularly contents protected by any intellectual or industrial property rights belonging to third parties when they do not have the authorization of the right holder, undermine or discredit the reputation or credit of each Entity or any entity comprising the FCC Group, are considered illegal, deceptive, or unfair advertising, and/or incorporate viruses or any other electronic element that could damage or prevent the functioning of the website, the network, computer equipment of each Entity or third parties, and/or access to the portal for other users.

The Entities may prohibit access to the Portal for any User who carries out any of the behaviors referenced, including but not limited to, in this section.

5. Intellectual and Industrial Property Rights

Each Entity is the owner or has obtained the corresponding license for the exploitation rights regarding intellectual, industrial, and image property of the contents available through it, including but not limited to texts, graphic designs, drawings, codes, software, photographs, videos, sounds, databases, indexes, images, brands, logos, expressions, and information, and, in general, any other creation protected by national regulations and international treaties on intellectual and industrial property (hereinafter, jointly, the Contents).

All intellectual and industrial property rights over the Contents are reserved, and, in particular, it is prohibited to modify, copy, reproduce, publicly communicate, transform, or distribute in any way all or part of the Contents included in the Portal for public or commercial purposes without the prior, express, and written authorization of the corresponding Entity or, where applicable, the holder of the corresponding rights.

The User's access and navigation of the Portal shall under no circumstances be understood as a total or partial waiver, transmission, license, or assignment of the aforementioned rights by each Entity.

Consequently, it is not permitted to remove, evade, or manipulate the copyright notice and any other identification data of the rights of each Entity or its holders incorporated into the Contents, as well as technical protection devices, digital fingerprints, or any information and/or identification mechanisms they may contain.

References to names and trademarks or registered trademarks, logos, or other distinctive signs, whether owned by each Entity or third-party companies, imply the prohibition of their use without the consent of each Entity or their legitimate owners. At no time, unless expressly stated otherwise, does access to or use of the Portal and/or its Contents confer on the user any right over the brands, logos, and/or distinctive signs included therein protected by Law.

6. Links

6.1 Links from the Portal to other websites

The Entities may offer links, directly or indirectly, to Internet resources or websites outside the Portal. The presence of these links on the Portal has an informational purpose and does not in any case constitute an invitation to contract products and/or services that are or may be offered on the destination websites, nor does it imply the existence of a link or commercial or dependency relationship with the entity owning the linked website. In these cases, the Entities shall not be responsible for establishing the general and particular conditions to consider in the use or provision of these services by third parties and, therefore, cannot be held responsible for them.

The Entities do not have the faculty, human resources, or technical means to know, control, or approve all the information, contents, products, or services provided by other websites to which links from the Portal may be established. Consequently, the Entities cannot assume any responsibility for any aspect relating to the websites to which a link from the Portal could be established, specifically, but not limited to, their operation, access, data, information, files, quality and reliability of their products and services, their own links, and/or any of their contents, in general.

Nevertheless, should the Entities gain effective knowledge that the activity or information referred to from these links is unlawful, constitutes a crime, or may harm the property or rights of a third party, they will act with the necessary diligence to remove or disable the corresponding link as soon as possible.

Likewise, if Users gain effective knowledge of the unlawfulness of activities carried out through these third-party websites, they must immediately communicate this to each Entity so that the access link to it can be disabled.

6.2 Links from other websites to the Portal

If any User, entity, or website wishes to establish any type of link to the Portal, they must adhere to the following stipulations:

(i) They must obtain the prior, express, and written authorization of each Entity.

(ii) The link may only be directed to the main page of the Portal unless expressly authorized otherwise.

(iii) The link must be absolute and complete; that is, it must take the User, via a click, to the main page and must completely cover the full extent of the screen of the Portal's main page. Under no circumstances, unless the Entities authorize otherwise, may the website establishing the link reproduce the Portal in any way, include it as part of its web or within one of its "frames," or create a "browser" over any of the Portal's pages.

(iv) On the website establishing the link, it may not be stated in any way that the corresponding Entity has authorized such a link, without this being the case. If the entity that correctly makes the link from its page to the Portal wishes to include on its website the brand, denomination, commercial name, sign, logo, or any other identifying sign of the Entity and/or the Portal, it must first have the prior, express, and written authorization of the Entity.

(v) In any case, the Entities prohibit the establishment of a link to the Portal from websites containing materials, information, or contents that are illicit, illegal, degrading, obscene, and generally contravene morals, public order, current legislation, generally accepted social norms, or that are harmful to the legitimate rights of third parties.

9. Duration and Modification

The Entities reserve the right to modify this Legal Notice and/or the particular conditions that, where applicable, have been established for the use of the services provided through the Portal, whenever they deem it appropriate or to adapt to legislative and technological changes, being valid and taking effect from their publication on the Portal.

The temporal validity of these conditions of use coincides, therefore, with the time of their display, until they are totally or partially modified, at which point the modified conditions of use will take effect.

The Entities may terminate, suspend, or interrupt, at any time without prior notice, access to the contents of the page, without the possibility of the User demanding any compensation. After such termination, the prohibitions on the use of contents set out previously in this Legal Notice will remain in force.

10. Communications

For any communication between the Entity and the User, the latter must address the Entity at the postal and/or electronic address indicated above. In any case, communications from the Entity to the User will be made following the contact details provided or supplied. The User expressly accepts the use of email as a valid procedure for the exchange of information and the remittance of communications between and/or with the Entity.

11. Generalities

The headings of the different clauses are informational only and shall not affect, qualify, or modify the interpretation of the Legal Notice.

In the event of a discrepancy between what is established in this Legal Notice and the particular conditions that, where applicable, may be established regarding the products or services offered on the Portal, the provisions of the particular conditions shall prevail.

Should any provision or provisions of this Legal Notice be considered null or unenforceable, in whole or in part, by any competent Court, Tribunal, or administrative body, such nullity or unenforceability will not affect the other provisions of the Legal Notice or the particular conditions that may have been established.

The non-exercise or non-execution by the Entities of any right or provision contained in this Legal Notice shall not constitute a waiver thereof, except with their written acknowledgment and agreement.

12. Applicable Law and Competent Courts

This Legal Notice and the relationships established between the Entities and the User, in particular the knowledge and resolution of any disputes, discrepancies, or differences that may arise, shall be governed by and resolved under the provisions of Spanish regulations relating to applicable legislation and competent jurisdiction.

However, for cases in which the regulations provide for the possibility of the parties submitting to a jurisdiction, the Entity and the User, expressly waiving any other jurisdiction that may correspond to them, will submit any controversies and/or litigation to the knowledge of the Courts and Tribunals of the city of the domicile of each Entity provided for in this Legal Notice.
