FCC Aqualia S.A. (hereinafter Aqualia or the organization), domiciled in Madrid and with Tax Identification Number (CIF) A26019992, on the occasion of the celebration of International Women's Day on March 8, 2026, organizes a campaign for the participation of its employees and citizens of the municipalities in which Aqualia (and its subsidiaries, Joint Ventures [UTES], and Mixed-ownership companies) provide services, through a specific website, Instagram, and X, which will be governed by these legal terms (hereinafter, the Terms).

Campaign

The campaign organized by Aqualia consists of the participation of employees and citizens where Aqualia provides services, by sending us, through the platform www.aqualiaequality.com (hereinafter, The Platform), a photograph in which the person or persons appearing show their hand(s) in a gesture that simulates the movement of a wave.

The photographs published on the site by the employees and citizens of the municipalities in which Aqualia (and its subsidiaries, Joint Ventures, and Mixed companies) provide services may, in turn, be shared on the social networks X, Instagram, Facebook, LinkedIn, and WhatsApp.

Subsequently, the photographs, messages, and data provided by each participant will become part of the Campaign's materials archive for Aqualia's use in communications and publications referencing this type of initiative supporting social issues by the organization.

Campaign Duration

The campaign will be active from 00:00 hours (GMT+1) on 02/24/2026 until 00:00 hours (GMT+1) on 03/10/2026.

If, due to force majeure or causes beyond Aqualia's control, it becomes necessary to postpone or modify the duration of the campaign, or to cancel or repeat it, participants will be notified of this fact through the Platform or via email or other internal Aqualia communication tools.

Description of Participants

The campaign organized by Aqualia is intended for the participation of all employees who are part of the company, as well as its subsidiaries, Joint Ventures, and Mixed companies in Spain, Colombia, Mexico, the United States, Egypt, the United Arab Emirates, and Saudi Arabia.

Citizens of the municipalities in which Aqualia (and its subsidiaries, Joint Ventures, and Mixed companies) provide services may also participate.

Campaign Communication

The public communication of the Campaign will take place starting February 24, 2026, through:

  • Internal communication channels available at Aqualia: intranet, posters in offices and facilities, informational Flashes, specific email blasts, etc.
  • The Platform: aqualiaequality.com
  • Aqualia's website: aqualia.com
  • Social networks: Instagram (@aqualia_official) and X (@aqualia).
  • Media outlets that report on the campaign.

Personal Data Protection

Following the European regulatory standard of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), Aqualia informs you that the personal data provided by you has been collected by Aqualia through the website www.aqualiaequality.com for the purposes of:

  • Managing the correct participation in the Campaign and its development.
  • Disseminating the Campaign, its results, and the photograph, messages, and data provided through any communication medium.

For the proper development of the Campaign, it will be necessary that the personal data of the participants, collected through the Platform, be truthful, complete, and up-to-date, to which they commit through the acceptance of these Terms. If a participant's personal data is untrue, false, incomplete, or not updated in such a way that identifying the participant is impossible by reasonable means, Aqualia reserves the right to disqualify them from the Campaign, being free from any responsibility in this regard.

For the correct development of the campaign, the User must consent to the processing of their personal data (including their image) so that they can be disseminated and displayed through any physical or digital medium, and/or in the internal/external location deemed of interest by Aqualia and/or by the rest of the Group's Entities (whose addresses and activities appear on the website www.fcc.es) worldwide, with the sole purpose of carrying out the actions specified above.

Likewise, in the event that the image of a third party is shown in the photograph submitted to the campaign, the participant assumes the duty to inform them about these Legal Terms, and especially about the Personal Data Protection information, as well as having obtained the express consent of the third party for the processing of their image by Aqualia under the terms and for the purposes indicated in this section. At any time, Aqualia may request proof of the existence of said consent.

IMPORTANT. DO NOT TAKE PICTURES OF MINORS. THEY MAY ONLY BE TAKEN IF THE MINOR IS UNIDENTIFIABLE OR APPEARS BLURRED.

We inform you that the company responsible for processing the Personal Data is FCC AQUALIA, S.A., whose postal address, for personal data protection purposes, is Av. Camino de Santiago 40, 28050 Madrid.

The purpose for which we process the personal data you have provided for registration is the development, management, and dissemination of the campaign.

The legitimacy for processing the provided personal data (name and surname, image, email, and department/service/city council and locality) is the execution and development of the campaign and the consent you have given, where applicable, for the processing of your personal data and/or, where applicable, of the third party whom you have previously informed and obtained consent from, for their dissemination on Aqualia's Social Networks and/or other physical and digital media.

Your personal data will be kept for the duration of the campaign and its publicity, or until you request its deletion. Once this dissemination is finished, we will keep your personal data blocked during the legal prescription periods; once these have elapsed, we will destroy your data.

Your data is not transferred to any third party unless we are legally obliged to do so.

The data protection rights you may exercise are the following:

  • Access: You have the right to know if we are processing your data and, if so, to know what personal data of yours we are processing.
  • Rectification: You have the right to rectify personal data that is inaccurate.
  • Deletion: Under certain circumstances, you may request the deletion of your data.
  • Limitation of processing: Under certain circumstances, you have the right to ask us to limit the processing of your data, in which case we inform you that we will only keep it for the exercise or defense of legal claims.
  • Portability: You have the right to receive, in electronic format, the personal data you have provided to us and those generated during the contractual relationship, as well as to transmit them to another entity.
  • Opposition: Under certain circumstances and for reasons related to your particular situation, you have the right to object to the processing of your data, in which case we would stop processing them except for compelling legitimate grounds, or the exercise or defense of possible legal claims.

You may exercise these rights by sending a written request with the ref. "Data Protection" addressed to FOMENTO DE CONSTRUCCIONES Y CONTRATAS, Dpto. Gestión de Clientes y Protección de Datos, Avda. del Camino de Santiago 40, 28050 Madrid, or by sending your request with the same requirements to protecciondatos@aqualia.es.

Finally, please note that you can file a claim with the supervisory authority (www.aepd.es).

By accepting these Terms, participants exclusively transfer to Aqualia, with the right of assignment to third parties, the image rights, as well as any other rights that may correspond to them as a result of their participation in the Campaign, which may be subject to public communication through various media (websites, magazines, newspapers, social networks, etc.).

For this purpose, the participant, if they have given their consent to Aqualia, authorizes the company to use the photograph or photographs submitted for participation and the participant's personal data that may be collected during the Campaign, to allow its exploitation through any modality, worldwide, and without time limit.

Aqualia informs interested parties that the processing of the provided personal image and identifying data necessarily involves the communication of the participants' and winners' data to any third party with access to the media and communication channels where the data of the interested parties are reproduced, published, or publicly communicated. When the reproduction, public communication, or publication of the interested parties' personal data takes place in media accessible from any country in the world, such as the Internet, the processing of the data will imply data processing with universal scope, meaning that even third parties located in countries without personal data protection regulations, or with regulations that have a lower level of protection than that provided by Spanish regulations, may access the data.

Intellectual Property Rights

The participant guarantees that they are the sole owner of the intellectual property rights of each of the photographs and messages submitted to the Campaign through the platform www.aqualiaequality.com and takes full responsibility that there are no third-party rights in the published content, as well as for any third-party claims regarding image and/or intellectual property rights.

Participation in the Campaign implies the exclusive and transferable assignment, for a worldwide territorial scope, throughout the entire period of validity of the intellectual property rights, and free of charge by the participant to Aqualia, of all exploitation rights derived from the creations with which they may participate in the Campaign.

The assignment of intellectual property rights as set forth in these terms does not generate or grant any reimbursement, fee or royalty payment, or economic rights of any kind for the participant.

Responsibilities

Aqualia reserves the right to cancel any participation or disqualify any participant if there are suspicions of improper manipulation of the data or the Campaign.

The organization reserves the right to reject or exclude from participating in the Campaign any participant who does not meet the requirements described in these terms and conditions of participation or who contravenes the rules or purpose of the Campaign.

The organization is not responsible for the malfunction of the Platform, nor for possible data loss due to email problems and/or internet malfunction.

Furthermore, the organization excludes any liability for damages of any nature that, despite the security measures adopted, may be due to the improper use of the services and content by users, and, in particular, but not exclusively, for damages of any nature that may be due to the impersonation of a third party carried out by a user in any kind of communication made through the Platform.

Nullity

If any provision of these Terms is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will only affect that provision or the part thereof that is null or ineffective, while the rest of the Terms will remain in full force and effect, and such provision or the affected part thereof will be considered unwritten, unless, because it is essential to these Terms, it should affect them entirely.

Jurisdiction and Applicable Law

These Terms shall be interpreted and governed in accordance with Spanish law. For any litigious issue arising from the existence, access, use, or content of the Terms, the participant and Aqualia expressly waive any other jurisdiction that may correspond to them, submitting to the exclusive jurisdiction and competence of the Courts and Tribunals of Madrid.
